These Vendor Terms & Conditions ("Vendor Terms") govern your participation as a vendor on thisandthat.rent. By applying to list or listing items on ThisandThat LLC, you agree to these Vendor Terms in addition to our general Terms of Service.
To become a vendor, you must submit an application with accurate business information. ThisandThat LLC reviews vendors and may accept, reject, or request more information at its discretion. Approval is not guaranteed.
You are an independent business, not an employee, agent, partner, or joint venturer of ThisandThat LLC. You are solely responsible for your own business operations, including taxes, licensing, and insurance.
You agree to provide accurate, complete, and up-to-date information for each listing, including photos, descriptions, pricing, and availability. You are responsible for keeping your inventory counts accurate to avoid overbooking.
During ThisandThat LLC's launch period, vendors pay 0% commission on bookings made through the platform. After launch, a commission may apply to completed bookings made through ThisandThat LLC. Founding vendors (those who join during the launch period) will receive advance notice of any commission changes and preferred terms.
When a booking is confirmed, you agree to deliver, set up, and/or provide the item(s) as described in your listing, on the agreed date and at the agreed location, unless otherwise communicated to the customer and ThisandThat LLC in advance.
If you are unable to fulfill a confirmed booking, you must notify ThisandThat LLC and the customer as soon as possible. Repeated cancellations may affect your standing on the platform.
You are solely responsible for any damage, injury, or loss arising from your items or services, including during delivery, setup, use, and pickup. If you list items that you install or set up at an event (such as balloon arches, backdrops, tents, or inflatables), or items that people sit, stand, or climb on, you must carry general liability insurance that covers those bookings. Either an annual policy or a per-event policy for each booking is acceptable. Please send us a current certificate of insurance before those items go live, and an updated one when your policy renews or changes. Vendors who joined before November 1, 2026 have until December 31, 2026 to provide one. Items that are only dropped off, such as signs, centerpieces, and table décor, do not require insurance, though we recommend it. We may pause listings that require insurance if we do not have a current certificate on file. ThisandThat LLC is not liable for any claims arising from your goods or services.
Payment terms, including timing and method, will be communicated separately as our payment infrastructure is finalized. ThisandThat LLC will provide reasonable advance notice of any changes to how or when vendors are paid.
You retain ownership of the photos, descriptions, and other content you submit. By submitting content, you grant ThisandThat LLC a non-exclusive, royalty-free license to display, reproduce, and promote it on the Site and in related marketing.
Either party may terminate this vendor relationship at any time. ThisandThat LLC may also remove or suspend a listing or vendor account for inaccurate information, repeated cancellations, customer complaints, or violation of these Vendor Terms.
Any disputes arising from these Vendor Terms will be governed by the laws of the State of New York. We encourage vendors to first reach out to hello@thisandthat.rent to resolve any issue directly.
We may update these Vendor Terms from time to time, with reasonable notice for material changes. Continued participation as a vendor after changes take effect constitutes acceptance.
